TERMS OF USE – DAHIM APPLICATION

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Dahim mobile application (the “App”), the website www.akhimllc.com, and all related services, features, content, and tools provided by AKHIM LLC, a Wyoming limited liability company (“Company”, “we”, “us”, or “our”).

The App is dedicated to Muslims and includes: nasheed, soundscapes, silent motivation letters, mood tracker, custom journal, authentic and custom duas, and a public talk section.

By accessing or using Dahim, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

If you use the App on behalf of another person or entity, you confirm that you have the authority to bind that person or entity to these Terms.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may use the App only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

The App is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it as soon as possible.

If you are under 18, we recommend that you review these Terms with your parent or guardian before using the App.

3. Accounts and Registration

To access certain features (e.g., mood tracker, journal, duas, talk section), you may need to create an account (“Account”). When you create an Account:

  • You must provide accurate and complete information.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your Account.

  • You must notify us immediately at support@akhimllc.com if you suspect any unauthorized use of your Account.

We may suspend or terminate your Account if you provide false or misleading information, violate these Terms, or for any other reason at our discretion.

4. Description of Service

Dahim provides:

  • Nasheed: audio content of Islamic music/vocals.

  • Soundscapes: ambient audio environments for focus, relaxation, and spiritual reflection.

  • Silent Motivation Letters: written reflections and encouragement.

  • Mood Tracker: tools to log and analyze your emotional state.

  • Custom Journal: a private space for writing thoughts, intentions, and reflections.

  • Authentic and Custom Duas: collections of supplications.

  • Talk Section: a community feature where users can post messages, comment, and interact.

The Company may update, modify, or discontinue any part of the App at any time, with or without notice. We are not obligated to continue providing any feature and may change or remove features in the future.

5. User Conduct and Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

  1. Violate Laws Use the App in violation of any applicable local, national, or international law, including laws related to:

    • Harassment, hate speech, discrimination, or threats.

    • Child sexual exploitation or abuse.

    • Defamation, fraud, or impersonation.

    • Intellectual property infringement.

  2. Harassment and Abuse * Harass, bully, threaten, or intimidate other users.

    • Post content that is abusive, hateful, racist, sexist, or discriminatory.

    • Encourage self-harm, violence, or illegal activities.

  3. Inappropriate Content in the Talk Section In the talk section, you must not post:

    • Content that violates Islamic principles in a harmful or offensive way (e.g., mockery of faith, propaganda for extremism).

    • Spam, advertising, or unsolicited commercial messages.

    • Links to malicious websites or malware.

    • Personal information of others without their consent.

  4. Intellectual Property Violations * Upload or share content that infringes on any third party’s copyright, trademark, or other rights.

    • Attempt to copy, modify, reverse engineer, or extract the App’s source code or algorithms.

  5. Technical Misuse * Attempt to interfere with the App’s operation (e.g., hacking, injecting code, using bots).

    • Use automated tools to scrape data, except as explicitly permitted by us.

  6. Fake or Misleading Information * Create false identities, impersonate others, or misrepresent your affiliation.

    • Spread misinformation intentionally in the talk section.

We may monitor, review, edit, or remove any content in the talk section at our discretion, without prior notice, if it violates these Terms or is otherwise inappropriate.

6. Intellectual Property Rights

6.1 Ownership of Our Content

All content provided by the Company in the App, including but not limited to:

  • Text, graphics, logos, icons, images, and audio clips (nasheed, soundscapes).

  • Software, algorithms, user interface design, and documentation.

  • The name “Dahim”, branding, and trademarks.

is owned by AKHIM LLC or its licensors and is protected by U.S. and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • Download and use the App on your personal device.

  • Access and use the content for your personal, non-commercial use as described in these Terms.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App or its content.

  • Remove any copyright or other proprietary notices.

  • Use our content to create a competing service.

6.2 Your Content

Where you submit content to the App (e.g., posts in the talk section, journal entries shared publicly, custom duas you create and share), you:

  • Retain ownership of your content.

  • Grant us a worldwide, non-exclusive, royalty-free license to:

    • Store, display, reproduce, and distribute your content within the App.

    • Promote the App using examples of user content (with your name or attribution only if you explicitly agree).

You are responsible for ensuring that your content does not violate any laws or third-party rights.

7. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

  • We collect information you provide (e.g., account data, journal entries, mood logs, talk section posts).

  • We may collect technical data (e.g., device type, IP address, usage statistics).

  • We use this data to operate the App, improve features, and communicate with you.

  • We do not sell your personal information to third parties for marketing purposes.

  • For users in the European Union, including France, we comply with applicable data protection laws (including GDPR) to the extent required for our operations.

If you are in the EU or UK, you have rights such as:

  • Access, correction, and deletion of your data.

  • Restriction or objection to certain processing.

  • Data portability.

Our Privacy Policy may be updated. Continued use of the App after changes constitutes acceptance of the updated policy.

8. Accounts, Data, and Content in Journal & Mood Tracker

Your journal entries and mood tracker data are considered personal and sensitive information. You agree:

  • To use these features responsibly and not to store content that violates laws or infringes on others’ rights.

  • That we may store and process this data to provide the functionality of the App.

  • That you can delete your data via the App or by contacting us.

We do not use your journal or mood data for advertising purposes. We may use aggregated, anonymized data for analytics and product improvement.

9. Talk Section – Community Guidelines and Risks

The talk section is a public community space. You acknowledge:

  • Content posted there is visible to other users.

  • We do not guarantee that all content is accurate, safe, or appropriate.

  • You should not share sensitive personal information (e.g., financial details, health records, passwords) in the talk section.

We are not responsible for:

  • Disputes between users.

  • Any harm resulting from interactions in the talk section.

  • The accuracy or reliability of user-generated content.

We may remove content or suspend users who violate these Terms, but we do not have an obligation to monitor all content constantly.

10. No Professional, Medical, or Legal Advice

Dahim is a wellness and spiritual support tool, not a medical, psychological, or legal service.

  • Content in the App (including nasheed, soundscapes, motivation letters, and duas) is for general informational and spiritual purposes only.

  • The mood tracker and journal are not diagnostic tools and should not replace professional mental health care.

  • If you are experiencing serious emotional distress, depression, anxiety, or other mental health concerns, consult a qualified professional.

We do not provide medical, psychological, or legal advice through the App or the talk section.

11. Third-Party Services and Links

The App may include links to third-party websites, services, or content (e.g., external nasheed sources, social media links). These are provided for convenience only.

  • We do not control, endorse, or assume responsibility for any third-party content or services.

  • Your use of third-party services is subject to their own terms and policies.

  • We are not liable for any damage or loss arising from your use of third-party services.

12. Payments and Subscriptions (If Applicable)

If you purchase any paid features, subscriptions, or digital products through the App:

  • You agree to pay all applicable fees as described at the time of purchase.

  • Payments are processed by third-party payment providers (e.g., Apple, Google, Stripe).

  • Refunds, cancellations, and billing disputes are handled according to the policies of the payment provider and our own refund policy, if applicable.

All fees are non-refundable except as expressly stated by us or required by law.

13. Disclaimers

13.1 No Warranty

The App and all content are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim:

  • That the App will be uninterrupted, secure, or error-free.

  • That any content is accurate, complete, or reliable.

  • Any warranties of merchantability, fitness for a particular purpose, or non-infringement.

13.2 No Guarantee of Outcomes

We do not guarantee that using the App will result in specific spiritual, emotional, or mental well-being outcomes. Your experiences depend on many factors, including your personal circumstances.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

  • AKHIM LLC and its officers, directors, employees, contractors, and licensors shall not be liable for any:

    • Indirect, incidental, special, consequential, or punitive damages.

    • Loss of profits, data, use, or other tangible or intangible losses.

  • Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the last six months (or, if you did not pay, $10 USD).

These limitations apply even if we have been advised of the possibility of such damages and regardless of the legal theory (contract, tort, negligence, etc.).

Some jurisdictions do not allow certain limitations of liability; in such cases, those limitations apply only to the extent permitted by law.

For the purpose of this limitation, ‘the amount you paid us in the last six months’ refers to the total fees you paid to AKHIM LLC for access to the App or related services during the six months immediately preceding the date of the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless AKHIM LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:

  • Your use of the App.

  • Your violation of these Terms.

  • Your content or interactions in the talk section.

  • Your infringement of any third-party rights.

16. Termination

We may suspend or terminate your access to the App, your Account, or any features at any time, with or without notice, for any reason, including:

  • Violation of these Terms.

  • Suspected fraud or security risks.

  • Operational or business decisions.

Upon termination:

  • Your right to use the App immediately ends.

  • You may still access certain features if required by law (e.g., to retrieve data).

  • Sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive.

You may also stop using the App at any time.

17. Changes to These Terms

We may update these Terms at any time. When we do:

  • We will update the “Last Update” date at the top.

  • We may notify you via the App, email, or other reasonable means.

  • Your continued use of the App after the changes constitutes acceptance of the new Terms.

If you do not agree to the new Terms, you must stop using the App and may request deletion of your data as described in the Privacy Policy.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

18.2 Mandatory Arbitration (U.S. Users)

If you are a user located in the United States:

  • You agree that any dispute, claim, or controversy arising from these Terms or your use of the App will be resolved by binding arbitration rather than in court, except that you may pursue claims in small claims court if eligible.

  • The arbitration will be conducted under the rules of a recognized arbitration provider (e.g., AAA or JAMS) in a location reasonably convenient to you.

  • Each party will bear its own costs, unless the arbitrator determines otherwise.

  • Opt-Out Right: You have the right to opt out of this mandatory arbitration provision within thirty (30) days of first creating your Account. To opt out, you must send a clear written notice specifying your decision to support@akhimllc.com. If you opt out, the remaining terms of this Arbitration section will not apply to you, and disputes will be resolved in accordance with Section 18.1 and applicable court rules.

18.3 Non-U.S. Users

If you are not a U.S. user:

  • You may pursue disputes in the courts of your country of residence, provided that such courts have jurisdiction.

  • However, we may still seek to resolve disputes through arbitration or in Wyoming if required by law or if we choose to do so.

20. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and us regarding the App.

  • Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in full force.

  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.

  • Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor entity.

  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, internet outages, government actions).
